Rules for Using Porsche AI

We, Porsche (China) Motor Limited (“Porsche” or "we”), hereby remind you that, before you register, sign in and use Porsche AI, please read the following Rules for Using Porsche AI (“Rules”) to ensure that you fully understand all terms of these Rules and carefully choose to accept or not accept the Rules. You may not register, sign in or use Porsche AI unless you accept all the terms of the Rules. Your registration, login and use will be deemed as acceptance of the Rules and you agree to be bound by the terms of the Rules.

The following rules apply to the use of Porsche AI, which you must observe and comply with:

Purpose Limitation

Porsche AI is provided as a work tool by Porsche and may only be used for Porsche purposes - explicitly not for private purposes or for the purposes of third parties.

For the above purposes, you must be a current employee of Porsche. Under the Rules, the word “employee" covers, as appropriate and applicable, the Porsche's directly-hired employees, staff members (including those who are employed by a third-party staffing agency and are dispatched to work for Porsche), part-time or full time employees, and any individuals seconded from Porsche's affiliates to provide services to Porsche, etc. The application of the Rules shall not change the individual's employment status.

Approved Devices

Porsche AI may not be used with private devices.

Accountability

• Porsche AI is just a tool: How you use Porsche AI and what you do with the answers and outputs is always your own responsibility.
• You are responsible for your input to Porsche AI, including ensuring that such input complies with these Rules and all applicable laws and does not violate or infringe any third party’s rights.
• Before entering any data into Porsche AI, check whether you are allowed to use the data for this purpose. This can be critical for Porsche’s and third-party’s trade secrets or copyrighted information. If in doubt, obtain the consent of the data owner.
• Outputs can be subject to assumptions, incorrect (hallucination), incomplete, offensive or biased, and do not represent Porsche’s views. Do not rely on the outputs from Porsche AI as your sole source of information.
• Always fully understand and comprehend the output from Porsche AI and check that it is correct in terms of content and language, complete, free of bias, and up to date before use.
• Outputs can violate the rights of third parties, especially with software code, images, longer creative texts, or other copyrighted works.
• Outputs from Porsche AI are not protected by copyright. Check whether there are identical works by third parties whose rights could be violated by use of the outputs from Porsche AI.

Responsibilities and Decisions

• Porsche AI does not replace the consultation of Porsche experts (legal department, tax department, data protection, technical conformity, etc.).
• Contact relevant Porsche colleagues with specific questions.
• Relevant business decisions must not be made solely on the basis of information from Porsche AI.
• Company guidelines and processes must always be adhered to.
• Furthermore, you may not:
• Use Porsche AI in a manner that violates these Rules or any applicable laws;
• oUse Porsche AI in a manner that violates or infringes anyone's legitimate rights;
• Reverse engineer, decompile or discover the source code or underlying components of Porsche AI;
• Use Porsche AI in any other way that may harm Porsche's interests.

Data Protection

• Input and chats are not tracked unless you use the feedback function.
• Chats are processed on a secure Porsche environment on Amazon Web Services.
• Entries are protected as on other Porsche PCN business systems.
• Do not enter any personal data in the chat.
• The data protection notice for PCN employees applies.

Information Security

• You are allowed to use data up to the classification "confidential" that has no personal reference.
• You are not allowed to enter data classified as "Secret".
• You are responsible for protecting valuable outputs from unauthorized access with technical measures or other proper measures.

Disclaimer

PORSCHE AI IS PROVIDED “AS IS” AND “AS AVAILABLE.” EXCEPT AS SET FORTH IN THESE RULES OR APPLICABLE LAWS, ALL WARRANTIES AND REPRESENTATIONS, INCLUDING, BUT NOT LIMITED TO, THE WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND ALL OTHER SIMILAR WARRANTIES ARE HEREBY EXPRESSLY EXCLUDED WITH RESPECT TO THE INFORMATION, CONTENT AND SERVICES PROVIDED BY PORSCHE AI. IN ADDITION, PORSCHE MAKES NO REPRESENTATION, WARRANTY, OR GUARANTEE AND SHALL NOT BE REGARDED TO MAKE SUCH REPRESENTATION, WARRANTY, OR GUARANTEE, REGARDING THE ACCURACY, AUTHENTICITY, COMPLETENESS, RELIABILITY, TIMELINESS, QUALITY, SUITABILITY, AVAILABILITY, SAFETY, STABILITY OF PORSCHE AI SERVICES.

YOU ACCEPT AND AGREE THAT ANY USE OF OUTPUTS FROM PORSCHE AI IS AT YOUR SOLE RISK AND YOU WILL NOT RELY ON OUTPUT AS A SOLE SOURCE OF INFORMATION OR FOR PROFESSIONAL ADVICE.

Change, Discontinuation and Termination of Services

• WE RESERVE THE RIGHT TO CHANGE, DISCONTINUE OR TERMINATE SOME OR ALL OF THE PORSCHE AI SERVICES AT ANY TIME.
• We will periodically or irregularly perform repair, maintenance or upgrade on the platform of Porsche AI. You agree that suspension of the Porsche AI services caused by such situation is reasonable. We shall not bear any responsibility for such suspension.
• In occurrence of any of the following circumstances, we may change, suspend, discontinue or terminate the Porsche AI services without any liability to you:
• You violate these Rules or any applicable laws;
• It is so required in accordance with the applicable laws or by the competent authority;
• For security or safety reasons or in other circumstances as deemed necessary by Porsche.

Others

• Porsche AI uses Qwen, which is an AI model developed by a third party, in a protected environment for Porsche.
• The validity, interpretation and dispute resolution of these Rules shall be governed by laws of People’s Republic of China.
• If any term in these Rules is held invalid or unenforceable for whatever reason, the remaining terms shall remain valid and shall be binding.
